Terms of Service, Consent & Texas Privacy Notice

Last updated: October 18, 2026 · Version 2026-10-18-v2

1. PROFESSIONAL SERVICES

Palliative Wellness Care & Massage is operated by Estela Guevara, Licensed Massage Therapist. Massage supports wellness and comfort; it does not diagnose, treat, or cure medical conditions and is not a substitute for care from a licensed medical provider.

2. INFORMED CONSENT FOR MASSAGE THERAPY

I understand that massage therapy is provided for stress reduction, relaxation, relief from muscle tension, and for general wellness. I acknowledge that massage therapists do not diagnose illness or disease, do not prescribe medications, and that nothing said in the course of a session should be construed as such.

3. HEALTH DISCLOSURE

I agree to disclose conditions, medications, allergies, recent procedures, pregnancy, injuries, skin concerns, or other contraindications that may affect massage safety. I will tell the therapist about changes before each session.

4. TEXAS PRIVACY NOTICE

We collect contact, date-of-birth, appointment, billing, health-history, and session-preference information to schedule services, evaluate massage safety, provide and document care, communicate with you, maintain required records, and operate the practice.

Records are kept in access-restricted, password-protected cloud services used to run this practice. Supabase is our database: your check-in, consents, and appointments are stored there. Vercel hosts this website. Google provides our email and calendar and stores encrypted backup files of the database. Backups are encrypted before they are stored and are kept for up to 60 days (30 days, plus up to 30 more if a file sits in Google Drive’s trash), so a record that has been erased from the live database can remain in an encrypted backup for that long. We do not sell personal or sensitive data or use health information for targeted advertising. We disclose information only to service providers supporting these stated purposes, when you authorize it, or when law requires it.

You may request access or correction by calling (832) 329-1264 or emailing palliativewellness@gmail.com. Deletion requests remain subject to legal duties, including the Texas requirement to retain massage records for at least two years. We will notify affected individuals of a qualifying data breach as required by law.

5. EMAIL COMMUNICATIONS

Appointment confirmations, reminders, receipts, and safety communications are part of the service you request. Promotional email is optional, requires the separate checkbox below, and may be stopped at any time.

6. CANCELLATION POLICY

We request at least 24 hours' notice for cancellation or rescheduling. Any cancellation or no-show fee will be disclosed and accepted before it applies.

7. RELEASE OF LIABILITY — PLEASE READ CAREFULLY

I UNDERSTAND AND AGREE THAT, TO THE FULLEST EXTENT TEXAS LAW ALLOWS, I RELEASE PALLIATIVE WELLNESS CARE & MASSAGE AND ESTELA GUEVARA (AND ANY EMPLOYEES OR CONTRACTORS) FROM CLAIMS FOR INJURY, ACCIDENT, OR ILLNESS ARISING FROM ORDINARY NEGLIGENCE IN CONNECTION WITH MY MASSAGE SERVICES, PROVIDED I HAVE TRULY DISCLOSED MY HEALTH INFORMATION. This release does not apply to gross negligence, intentional misconduct, or violations of law, and it does not limit any right that cannot lawfully be waived.

8. PHOTOGRAPHY & RECORDING

No photography or recording of any kind is permitted during sessions without the explicit written consent of both the client and therapist.

9. MINORS

Clients under age 18 cannot use self-service online check-in. A parent or legal guardian must contact the practice so the required consent can be documented before massage services.

10. APPOINTMENT ONLY

All services are by appointment only. For an accessible alternative to online booking or check-in, call (832) 329-1264.

11. LICENSING AND COMPLAINTS

Estela Guevara is a massage therapist licensed and regulated by the Texas Department of Licensing and Regulation (TDLR). To make a complaint about a licensee, contact TDLR at P.O. Box 12157, Austin, Texas 78711, (800) 803-9202 or (512) 463-6599, tdlr.texas.gov.
